In ‘Finkish Dispositions’, David Lewis proposed a revised conditional analysis of dispositions, designed to rule out counterexamples based on finkish dispositions and finkish lacks of dispositions. Bird and Choi have argued that Lewis’s amended analysis is vulnerable to two further types of counterexamples trading on mimicked and masked dispositions. This paper provides a diagnosis of why Lewis’s analysis inherits these problems, and investigates whether the means can be found—in Lewis’s paper or elsewhere—to defend his analysis against the counterexamples. A range (...) of strategies for defending conditional analyses against masking and mimicking counterexamples are assessed. The conclusion is that none of them will save Lewis’s analysis; some strategies fail, while the rest threaten to make Lewis’s amendments redundant. The discussion offers a number of general lessons about how to defend conditional analyses of dispositions. (shrink)

This thesis investigates the distinction, or distinctions, between response-dependent and response-independent concepts or subject matters. I present and discuss the three most influential versions of the distinction: Crispin Wright’s, Mark Johnston’s, and Philip Pettit’s. I argue that the versions do not compete for a single job, but that they can supplement each other, and that a system of different distinctions is more useful than a single distinction. I distinguish two main paradigms of response-dependence: response-dependence of subject matter, and response-dependence of (...) concepts only. I develop Pettit’s ‘ethocentric’ story of concept acquisition into an account of concept evolution that suggests answers to a range of hard questions about language, reality, and the relation between them. I argue that while response-dependence theses of subject matter can be motivated in very different ways, the resulting theses are less different than they might seem. I suggest that the traditional ways of distinguishing response-dependent subject matters from response-independent ones – in terms of a priori biconditionals connecting facts of the disputed class with responses in subjects in favourable conditions, and fulfilling some further conditions such as non-triviality and sometimes necessity – may not be the best approach. I also discuss two general problems for response-dependence theses: the problem of ‘finkish’ counterexamples, and the problem of specifying the ‘favourable conditions’ a priori, yet in a non-trivial way. The discussion of response-dependence is informed by a framework based on the idea that some realism disputes can be viewed as location disputes: disputes over the correct location of the disputed properties among several levels of candidate properties. The approach taken in this work is a charitable one: I try to make sense of response-dependence. The conclusion is the correspondingly optimistic one that the idea of response-dependence makes sense. Response-dependence theses are usually formulated in terms of a priori true biconditionals of roughly the form 'something, x, falls under the concept 'F' ↔ x would elicit response R from subjects S under conditions C'. Such formulations are vulnerable to conditional fallacy problems; counterexamples threaten whenever the C-conditions' coming to obtain might alter the object with respect to F. Crispin Wright has suggested that such problems can be avoided by placing the C-conditions in a proviso. This ensures that any changes (...) triggered by the C-conditions' coming to obtain will be irrelevant to the truth of the biconditional. I argue that this move leaves the equations vulnerable to counterexamples of a slightly different kind: Cases where the change is triggered, not by the C-conditions' coming to obtain, but by the response. I consider two ways to resist these counterexamples, and argue that both are insufficient. The upshot is a challenge that must be met if provisoed biconditionals are to serve their purpose. (shrink)

Are counterfactuals with true antecedents and consequents trivially true? The principle of Conjunction Conditionalization →) is highly controversial. Many philosophers view it as an attractive feature of Lewis’s semantics for counterfactuals that it can easily be modified to avoid this principle. However, Walters and Williams beg to differ. They argue that Conjunction Conditionalization is an indispensable ingredient of any Lewisian semantics, since CC is entailed by standard Lewisian theorems and a plausible semantic claim about irrelevant semifactuals. If this is true, (...) the entire tradition of revisionist counterfactual semantics is misguided, and so are many philosophical theories in which counterfactuals play a role. We argue, in defense of the revisionist tradition, that Walters and Williams’ ‘plausible semantic claim’ is in fact anything but plausible. The proper role of non-epistemic values such as moral, political, and social values in practices of justification of policy-relevant hypotheses has recently become one of the central questions in philosophy of science. This strand of research has yielded conceptual clarifications and significant insight into the complex and notoriously contentious issue of the proper relationship between science, non-epistemic values, and policymaking. The role of scientists as experts is crucial to public policymaking. However, the expert role is contested and unsettled in both public and scholarly discourse. In this paper, I provide a systematic account of the role of scientists as experts in policymaking by examining whether there are any normatively relevant differences between this role and the role of scientists as researchers. Two different interpretations can be given of how the two roles relate to each other. The separability view states that (...) there is a normatively relevant difference between the two roles, whereas the inseparability view denies that there is such a difference. Based on a systematic analysis of the central aspects of the role of scientists as experts – that is, its aim, context, mode of output, and standards, I propose a moderate version of the separability view. Whereas the aim of scientific research is typically to produce new knowledge through the use of scientific method for evaluation and dissemination in internal settings, the aim of the expert is to provide policymakers and the public with relevant and applicable knowledge that can premise political reasoning and deliberation. According to Nozick’s tracking theory of knowledge, an agent a knows that p just in case her belief that p is true and also satisfies the two tracking conditionals that had p been false, she would not have believed that p , and had p been true under slightly different circumstances, she would still have believed that p . In this paper I wish to highlight an interesting but generally ignored feature of this theory: namely that it is reminiscent of (...) a dispositional account of knowledge: it invites us to think of knowledge as a manifestation of a cognitive disposition to form true beliefs. Indeed, given a general account of dispositions in terms of subjunctive conditionals, the two tracking conditionals are satisfied just in case the belief in question results from some cognitive disposition to form true beliefs. Recently, such a conditional account of dispositions has, however, been criticised for its vulnerability to so-called ‘masked’, ‘mimicked’ and ‘finkish’ counterexamples. I show how the classical counterexamples to Nozick’s theory divide smoothly into four corresponding categories of counterexamples from epistemic masking, mimicking and finkishness. This provides strong evidence for the thesis that satisfaction of the two tracking conditionals is symptomatic of knowledge and that knowledge is instead constituted by a dispositional capability to form true beliefs. The attempt to capture such a cognitive, dispositional capability in terms of the tracking conditionals, although providing a good approximation in a wide variety of cases, still comes apart from the real thing whenever the epistemic layout is characterised by masking-, mimicking- and finkish mechanisms. In the last part of the paper I explore the prospect of improving the tracking theory in the light of these findings. (shrink)

The aim of this study is to explore how nurses perceive patient participations of patients over 75 years old undergoing hemodialysis treatment in dialysis units, and of their next of kin. Ten nurses told stories about what happened in the dialysis units. These stories were analyzed with critical discourse analysis. Three discursive practices are found: (1) the nurses’ power and control; (2) sharing power with the patient; and (3) transferring power to the next of kin. The first and the predominant (...) discursive practice can be explained with an ideology of paternalism, in which the nurses used biomedical explanations and the ethical principle of benefice to justify their actions. The second can be explained with an ideology of participation, in which the nurses used ethical narratives as a way to let the patients participate in the treatment. The third seemed to involve autonomous decision-making and the ethical principle of autonomy for the next of kin in the difficult end-of-life decisions. (shrink)

If our moral beliefs rest on a mistake, as moral error theorists claim, what should we do with them? According to Richard Joyce’s revolutionary moral fictionalism, error theorists should pretend to believe moral propositions in order to keep the benefits moral thinking has for their preference satisfaction. This, he claims, frees error theory from radical practical implications. In response, I argue that implementing fictionalism would not preserve our moral practices, but disrupt them. The change from moral belief to make-belief yields (...) an unintended second revolution: a revolution in the content of morality. I show that fictionalism necessarily relies on a similar justification of moral practices as David Gauthier’s contractarianism, and consequently has similar implications for moral content. Because fictionalists engage in moral thinking purely for its instrumental value, they should only accept moral obligations that are useful to them into their fiction. This restriction is important: the most useful moral fiction departs substantially from conventional moral views. Revolutionary moral fictionalism is therefore more radical than it is promised to be. Background: Since the adoption of the Universal Declaration of Human Rights by the United Nations in 1948, human rights as set out in government documents have gradually changed, with more and more power being transferred to individual. Objectives: The aim of this article is to analyze how the position of the patient in need of care is constructed in Norway’s renamed and revised Patients’ and Service Users’ Rights Act (originally Patients’ Rights Act, 1999) and published comments which accompanying this legislation (...) from the Norwegian Ministry of Health and Care Service. Research design: A constructivist design was used, and Fairclough’s critical discourse approach was adopted to analyze the text of the Patients’ and Service Users’ Rights Act and comments. Findings: The analysis identified three discourses: (a) political discourse, containing ethical discourses about priority and economy, in which patients are constructed as powerless individuals; (b) expert discourse, containing a theme about patients’ trust in the healthcare team and its knowledge, in which patients are constructed as helpless individuals lacking knowledge; and (c) patient participation and patient autonomy discourse, containing ethical discourses about decision-making, in which patients are constructed not only as individuals with needs and rights but also as “troublesome.” Conclusion: Dominant paternalistic discourses in the legal text validate the power of medicine, the healthcare system, and heath personnel over the needs, rights, participation, and autonomy of the patient. This paper examines the conditions of trustworthy science advice mechanisms, in which scientists have a mandated role to inform public policymaking. Based on the literature on epistemic trust and public trust in science, we argue that possession of relevant expertise, justified moral and political considerations, as well as proper institutional design are conditions for trustworthy science advice. In order to assess these conditions further, we explore the case of temporary advisory committees in Norway. These committees exemplify a de facto trusted (...) and seemingly well-functioning science advice mechanism. Still, this mechanism turns out to poorly realize some central conditions of trustworthy science advice. From this we draw three lessons. Firstly, it remains crucial to distinguish between well-placed and de facto trust. Secondly, some conditions of trustworthy science advice seem more significant than others and there are thresholds for realizing each condition. Thirdly, not only does the institutional design and organization of science advice matter more than often recognized; the trust and trustworthiness of the broader social and political context and institutional environment make a difference as well. This article examines the role of medical doctors, AI designers, and other stakeholders in making applied AI and machine learning ethically acceptable on the general premises of shared decision-making in medicine. Recent policy documents such as the EU strategy on trustworthy AI and the research literature have often suggested that AI could be made ethically acceptable by increased collaboration between developers and other stakeholders. The article articulates and examines four central alternative models of how AI can be designed and applied (...) in patient care, which we call the ordinary evidence model, the ethical design model, the collaborative model, and the public deliberation model. We argue that the collaborative model is the most promising for covering most AI technology, while the public deliberation model is called for when the technology is recognized as fundamentally transforming the conditions for ethical shared decision-making. Gettier's reminder that knowledge cannot be identified with justified true belief started a heated debate about what knowledge really is.

We know things that entail things we apparently cannot come to know. This is a problem for those of us who trust that knowledge is closed under entailment. In the paper I discuss the solutions to this problem offered by epistemic disjunctivism and contextualism. The contention is that neither of these theories has the resources to deal satisfactory with the problem.

Swedish beef and dairy farmers are currently facing a challenging financial situation. Simultaneously, beef farming contributes significant environmental impacts. To support farmers, actors from the whole value chain are now promoting Swedish beef as particularly ‘sustainable’. The paper draws on critical discourse analysis of interviews with and documents from the largest Swedish supermarket chain ICA, Swedish farmer organisations and farmers to study how ICA and farmers articulate sustainability and their responsibility for the same. Articulations are subsequently discussed in the light (...) of actual environmental impacts of beef production and the distribution of power in the beef value chain. The findings suggest that negative environmental impacts and farmers’ struggles are largely hidden in the dominant articulation of sustainability. Furthermore, ICA does not use the power it has to steer consumers toward reduced beef consumption. We conclude with suggesting more open deliberation about current levels of beef sales and consumption and about what compromises to make when striving for ‘sustainable’ beef consumption. (shrink)

Perception of music and speech is based on similar auditory skills, and it is often suggested that those with enhanced music perception skills may perceive and learn novel words more easily. The current study tested whether music perception abilities are associated with novel word learning in an ambiguous learning scenario. Using a cross-situational word learning (CSWL) task, nonmusician adults were exposed to word-object pairings between eight novel words and visual referents. Novel words were either non-minimal pairs differing in all sounds (...) or minimal pairs differing in their initial consonant or vowel. In order to be successful in this task, learners need to be able to correctly encode the phonological details of the novel words and have sufficient auditory working memory to remember the correct word-object pairings. Using the Mistuning Perception Test (MPT) and the Melodic Discrimination Test (MDT), we measured learners’ pitch perception and auditory working memory. We predicted that those with higher MPT and MDT values would perform better in the CSWL task and in particular for novel words with high phonological overlap (i.e., minimal pairs). We found that higher musical perception skills led to higher accuracy for non-minimal pairs and minimal pairs differing in their initial consonant. Interestingly, this was not the case for vowel minimal pairs. We discuss the results in relation to theories of second language word learning such as the Second Language Perception model (L2LP). As thousands of healthy research participants are being included in small and large imaging studies, it is essential that dilemmas raised by the detection of incidental findings are adequately handled. Current ethical guidance indicates that pathways for dealing with incidental findings should be in place, but does not specify what such pathways should look like. Building on an interview study of researchers’ practices and perspectives, we identified key considerations for the set-up of pathways for the detection, management and communication of (...) incidental findings in imaging research. We conducted an interview study with a purposive sample of researchers at research facilities across the Netherlands. Based on a qualitative analysis of these interviews and on existing guidelines found in the literature, we developed a prototype ethical framework, which was critically assessed and fine-tuned during a two-day international expert meeting with bioethicists and representatives from large population-based imaging studies from the United Kingdom, Germany, Sweden and Belgium. Practices and policies for the handling of incidental findings vary strongly across the Netherlands, ranging from no review of research scans and limited feedback to research participants, to routine review of scans and the arrangement of clinical follow-up. Respondents felt that researchers do not have a duty to actively look for incidental findings, but they do have a duty to act on findings, when detected. The principle of reciprocity featured prominently in our interviews and expert meeting. We present an ethical framework that may guide researchers and research ethics committees in the design and/or evaluation of appropriate pathways for the handling of incidental findings in imaging studies. The framework consists of seven steps: anticipation of findings, information provision and informed consent, scan acquisition, review of scans, consultation on detected abnormalities, communication of the finding, and further clinical management and follow-up of the research participant. Each of these steps represents a key decision to be made by researchers, which should be justified not only with reference to costs and/or logistical considerations, but also with reference to researchers’ moral obligations and the principle of reciprocity. Increasing the participation of women in top-level corporate boards is high on the agenda of policy-makers. Yet, we know little about director appointment dynamics and the drivers and impediments of women appointments. This study builds on organizational and group-level behavior theories and empirically investigates how ex-ante board structures and gender-specific board dynamics impact the representation of women on corporate boards. We study boards of listed firms in Europe between 2002 and 2019 and find a declining appointment probability for every additional (...) woman, i.e., the share of women already on the board negatively predicts the likelihood of additional women appointments. Further, we find evidence of a replacement effect, i.e., the likelihood of a woman being appointed as director is significantly larger when a woman, compared to when a man, leaves the board. We do not find spillover effects from non-executive to executive boards. These results are robust to econometric model specifications that address potential endogeneity concerns using matching and instrumental variables. Our results confirm that board director appointments are gender specific and suggest that demand-side factors such as explicit and implicit norms drive women appointments up to a certain threshold. This short essay argues that more attention should be paid to conventional norms in metaethics and metanormative theory.

Background: According to Norwegian law, nurses are obligated to provide an acceptable level of health assistance to patients and their family members and to allow patients and their family members to participate in the planning of patient care and treatment. Aim: The aim of this study is to compare the perceptions of older patients undergoing haemodialysis treatment and of their next of kin and of nurses regarding patient participation in the context of haemodialysis treatment. Research design: The study adopts an (...) approach that is both comparative and explorative in nature by examining the narratives of patients, nurses and next of kin and by performing critical discourse analysis as outlined by Fairclough. Ethical considerations: Permission to carry out the research was granted by the Regional Committee for Medical and Health Research Ethics of Mid-Norway and by the participating hospitals. Informed consent and confidentiality were ensured. Findings: Two discourses were found: (a) the discourse of paternalism with the discursive practices of achieving physiological balance in patients, trusting the healthcare team and being excluded or included in the difficult end-of-life decision-making process, and (b) the discourse of patient participation, with the themes of maintaining patients’ quality of life and trusting patients. Conclusion: The participation of older patients and their next of kin was not as well integrated as social practice in dialysis units. The dominant discourse seemed to have an ideology and social practice of paternalism. However, there existed hegemonic struggles for an ideology of patient participation that involved (a) achieving physiological balance in patients versus maintaining patients’ quality of life, (b) trusting the healthcare team versus trusting the patient, and (c) being excluded versus included in the difficult end-of-life decision-making process. During the COVID-19 pandemic, investigational treatments have been made available to seriously ill patients through so-called expanded access programmes, such as compassionate use and named-patient programmes. Many countries have legal, ethical and professional frameworks in place to promote safe and responsible use of investigational treatments outside of clinical trial settings. However, these frameworks leave room for ambiguities regarding the roles and responsibilities of treating physicians, hospital-based pharmacists, pharmaceutical companies, and other stakeholders, and for practices to differ, not only between countries, (...) but also within countries, between hospitals and individual healthcare providers. Current ambiguities with regard to physicians’ moral duties, for instance, allow physicians to withhold information from patients about options for expanded access, and to forego pursuing such options for their patients. This chapter describes the experiences with the use of Remdesivir and hydroxychloroquine in COVID-19-infected patients in the Netherlands during the first wave of the pandemic, and discusses an open question in relation to treating physicians’ duties, namely vis-à-vis information provision. This chapter proposes a prima facie obligation for healthcare professionals to inform eligible patients about relevant options for expanded access. (shrink)

Desenvolve-se uma releitura dessa teoria cuja racionalidade seja justiça, com base em Aristóteles, Rawls, Dworkin e Amartya Sen. Metodologicamente, a técnica de pesquisa é teórica, o método de abordagem é dialético e o método de procedimento é monográfico. O objetivo é demonstrar que a teoria da justiça no direito do ocidente levou à sua conexão com a teoria (...) do desenvolvimento. Background Coercion can cause harm to both the patient and the patient’s family. Few studies have examined how the coercive treatment of a close relative might affect young next-of-kin. Research questions We aimed to investigate the views and experiences of health professionals being responsible for supporting young next-of-kin to patients in mental health care (children-responsible staff) in relation to the needs of these young next-of-kin in coercive situations and to identify ethical challenges. Research design We conducted a qualitative study based (...) on semistructured, focus group interviews and an individual interview. Participants and research context We held three focus group interviews with six to seven children-responsible staff in each group (a total of 20 participants) and one individual interview with a family therapist. The participants were recruited from three hospital trusts in the eastern part of Norway. Ethical considerations The study was approved by the National Data Protection Official for Research and based on informed consent and confidentiality. Findings Coercion was not a theme among the participants in relation to their work with young next-of-kin, and there was much uncertainty related to whether these young people need special support to deal with the coercive treatment of their close relative. Despite the uncertainty, the study indicated a need for more information and emotional support among the youth. Discussion Few studies have addressed the potential impact of coercive treatment of a close family member on young next-of-kin. The findings were consistent with existing research but highlighted disagreement and uncertainty among the children-responsible staff about to what extent the young next-of-kin should visit and whether they should enter the ward unit or not. We identified ethical challenges for the children-responsible staff related to the principle of not inflicting harm ( nonmaleficence). Conclusion From the perspective of children-responsible staff, it appears that the coercive treatment of a close family member entails a need for extra support of young relatives both in relation to information and the facilitation of visits, but more systematic knowledge about these issues is needed. Can state sovereignty justify privileged receiving countries exercising authority over non‐members in a third country to safeguard their own interests? Under the current migration governance of the EU, state sovereignty is manifested in migrant interdiction, interception and detention policies employed to prevent unauthorized migrants from reaching the EU, and even from attempting to embark on cross‐Mediterranean journeys. While reinforcement of the Schengen region's external borders is a key aim of the EU's internal migration politics, collaboration with third countries regarding migration (...) control has, in the last decade, become a key feature of its external migration policy. In close collaboration with third countries, the EU has managed to curb the outflux of migrants from transit and sending countries. In effect, irregular migrants are prevented from exiting as well as from entering. This article explores the justifiability of such practices, by questioning commonly invoked models of justification such as the sovereignty “model”, with a special focus on partnership agreements regarding migration control between the EU and Libya. This article explores how paid domestic work is framed in state policies and discourses, drawing upon theoretical discussions on gender, welfare and global care chains. Based on a case study of the political debate on the `reconciliation of personal, family and work life' in Spain, the author argues that dominant policy frames relate gender inequality to women's unpaid domestic work and care, while domestic workers are essentially the invisible `other'. Empowering and disempowering frames are discussed; domestic workers are mainly constructed (...) as a solution to the care problem and only marginally as subjects and rights-holders. The overall aim is to examine how public policies legitimize and produce social inequalities related to gender, class and nationality. (shrink)

We review evidence regarding Tomasello et al.'s proposal that individuals with autism understand intentions but fail socially because of a lack of motivation to share intentions. We argue that they are often motivated to understand others but fail because they lack the perceptual integration skills that are needed to apply their basically intact theory of mind skills in complex social situations.

Cognitive models of depression posit that persistent negative self-referent thinking (PNSRT) is an important vulnerability factor for depressive symptoms. The mechanisms involved are still understudied, especially in adolescence. PNSRT has been assessed by a behavioural decision-making task, namely the emotional reversal learning task (ERLT). Within the ERLT, PNSRT is operationalised as the learning rate for negative self-reference. The first aim of the current study is to examine the association between PNSRT and depressive symptoms at baseline and follow-up. Second, the current (...) study investigated associations of PNSRT with temperamental and emotion regulation variables. We found no significant effect between PNSRT and baseline depressive symptoms, although the small effect size pointed in the expected direction. No significant prospective effect was found. Additionally, adolescents with greater capacity for response inhibition and better attentional control exhibited less PNSRT. No other significant associations were found with other temperamental dimensions or emotion regulation variables. In conclusion, while the small effect size of the cross-sectional association between PNSRT and depressive symptoms points in the expected direction, no significant evidence was found that PNSRT acts as either a concomitant or precursor to depressive symptomatology. However, the current study did find a relation between low effortful control and PNSRT. (shrink)

Modern health care devices admit a transfer of patients with rather complex care needs from institutions to the home care setting. With care recipients set up with health monitoring technologies at home, spouses and children are likely to become involved in the caring process and (...) informal caregivers may have to assist kin-persons with advanced care needs by means of sophisticated technology. This paper investigates some of the ethical implications of a near-future shift from institutional care to technology-assisted home care and the subsequent impact on the care recipient and formal- and informal care providers. The advent of new genetic and genomic technologies may cause friction with the principle of respect for autonomy and demands a rethinking of traditional interpretations of the concept of informed consent. Technologies such as whole-genome sequencing and micro-array based analysis enable genome-wide testing for many heterogeneous abnormalities and predispositions simultaneously. This may challenge the feasibility of providing adequate pre-test information and achieving autonomous decision-making. At a symposium held at the 11th World Congress of Bioethics in June 2012 (Rotterdam), organized by (...) the International Association of Bioethics, these challenges were presented for three different areas in which these so-called ‘new genetics’ technologies are increasingly being applied: newborn screening, prenatal screening strategies and commercial personal genome testing. In this article, we build upon the existing ethical framework for a responsible set-up of testing and screening offers and reinterpret some of its criteria in the light of the new genetics. As we will argue, the scope of a responsible testing or screening offer should align with the purpose(s) of testing and with the principle of respect for autonomy for all stakeholders involved, including (future) children. Informed consent is a prerequisite but requires a new approach. We present preliminary and general directions for an individualized or differentiated set-up of the testing offer and for the informed consent process. With this article we wish to contribute to the formation of new ideas on how to tackle the issues of autonomy and informed consent for (public) healthcare and direct-to-consumer applications of the new genetics.
